These Terms of Service govern your access to and use of the Tides Peps website and your purchase of products from Tides Peps.

By accessing the website, creating an account, placing an order or starting a subscription, you agree to these Terms of Service and our Privacy Policy.

If you do not agree with these Terms, do not use the website or purchase products from Tides Peps.

1. About Tides Peps

Tides Peps operates from British Columbia and sells products to customers in Canada, excluding Quebec.

Questions concerning these Terms may be submitted through the contact form on the Tides Peps website.

2. Age and Eligibility

You must be at least 19 years old to place an order or create a subscription.

By placing an order, you represent that:

  • You are at least 19 years old.
  • You have the legal capacity to enter into a binding agreement.
  • The information you provide is complete and accurate.
  • You are purchasing the products only for lawful research purposes.
  • You are authorized to use the selected payment method.

Tides Peps may request additional information when reasonably necessary to verify an order, prevent fraud or confirm eligibility. We may refuse, suspend or cancel an order if we cannot reasonably verify the information provided.

3. Research Purposes Only

Products sold by Tides Peps are offered strictly for lawful research purposes.

Products are:

  • Not for human consumption
  • Not for veterinary consumption
  • Not intended to diagnose, treat, cure or prevent any disease or medical condition
  • Not intended to be used as medications, supplements, cosmetics or food products
  • Not intended to be administered to any person or animal

Tides Peps does not provide medical advice, treatment advice, dosage information, administration instructions or individualized product recommendations.

Information on the website is provided for general product identification and informational purposes only. It is not medical, pharmaceutical, veterinary or professional advice.

You are responsible for ensuring that your purchase, possession, storage, handling and use of any product complies with all applicable laws and appropriate research standards.

4. Prohibited Uses

You must not:

  • Use a product for human or veterinary consumption.
  • Administer a product to another person or animal.
  • Use a product for diagnostic, therapeutic or medical purposes.
  • Use, possess, store or handle a product contrary to applicable law.
  • Purchase a product on behalf of a person who does not meet these Terms.
  • Resell or redistribute a product without written authorization from Tides Peps.
  • Remove, obscure, replace or alter a product label.
  • Make false or misleading claims about a product’s purity, safety, performance, effects or regulatory status.
  • Represent Tides Peps products as approved medications, treatments, supplements or consumer health products.
  • Provide false information concerning your identity, age, payment details, address or intended use.
  • Engage in fraud, chargeback abuse or misuse of a payment system.
  • Use affiliate or referral links deceptively.
  • Submit false, misleading or fabricated reviews.
  • Scrape, harvest or automatically extract website data without authorization.
  • Attempt to gain unauthorized access to the website, customer accounts, servers or administrative systems.
  • Upload malicious code or interfere with the security or operation of the website.
  • Copy or commercially exploit website content, product descriptions, photographs, graphics or branding without permission.

Tides Peps may refuse service, cancel orders, restrict website access, withhold affiliate credit, or suspend or delete accounts when we reasonably believe these Terms have been violated, subject to applicable law.

5. Product Information

We try to present accurate product information, but website content may occasionally contain errors, omissions or outdated information.

Product photographs, packaging illustrations, colours, dimensions and other images are provided for informational purposes. The appearance of the product or packaging received may differ from what is shown.

Descriptions, prices, promotions, discounts, availability and other website information may be corrected or changed without notice.

Tides Peps does not guarantee any particular purity, potency, sterility, composition, suitability, performance or research result except where a specific written representation is expressly provided by Tides Peps and cannot legally be excluded.

6. Certificates of Analysis

Tides Peps may make third-party certificates of analysis or testing information available in the future.

Unless expressly stated otherwise:

  • A certificate or test result applies only to the batch, lot or sample identified in that document.
  • Results for one batch must not be interpreted as results for another batch.
  • Testing reflects the sample and testing methods used at the time of analysis.
  • Third-party testing does not constitute medical advice or approval for human or veterinary use.
  • Availability of a certificate does not create a warranty beyond any rights that cannot legally be excluded.

Certificates and testing information must not be altered, misrepresented or used to make unsupported claims about Tides Peps or its products.

7. Orders

Submitting an order is an offer to purchase. An order is normally considered accepted once payment has been successfully received, but acceptance does not prevent Tides Peps from subsequently reviewing, refusing or cancelling the order where permitted by law.

Tides Peps may refuse or cancel an order at its discretion, including when:

  • A product is unavailable.
  • The website contains a pricing, description or inventory error.
  • Payment cannot be verified.
  • Fraud or unauthorized activity is suspected.
  • Customer or shipping information appears incomplete or inaccurate.
  • An order appears intended for resale or prohibited use.
  • An unusually large order requires additional review.
  • Fulfilling the order could violate applicable law or these Terms.

If Tides Peps cancels a paid order, the amount paid for the cancelled portion will normally be refunded using the original payment method or another reasonable method appropriate to the original payment.

Large orders may be held for review. Tides Peps may contact the customer for additional information, reduce the requested quantity, divide the shipment, or cancel and refund all or part of the order.

8. Prices, Discounts and Taxes

Prices are shown in Canadian dollars unless stated otherwise.

Applicable taxes, shipping charges and other disclosed charges are added during checkout.

Prices, promotions and discounts may change without notice. A promotion may be modified or withdrawn at any time unless prohibited by law.

Free standard shipping may be available on eligible orders over $350 before tax and after discounts. Eligibility may depend on the destination, products ordered, selected delivery service and any conditions stated with the promotion.

Discounts cannot be combined unless expressly permitted. Tides Peps may correct or cancel orders affected by pricing, discount, coupon or website errors.

9. Payment

Available payment methods may include:

  • Credit or debit card
  • Stripe
  • Apple Pay
  • Google Pay
  • Interac e-Transfer

Card and digital-wallet payments are processed by Stripe or the applicable payment provider. Tides Peps does not store complete payment-card information.

You authorize Tides Peps and its payment providers to process the charges associated with your order or subscription.

An order may be delayed or cancelled if payment is incomplete, reversed, disputed or not received within the required period.

10. Shipping and Delivery

Tides Peps generally ships through Canada Post but may use another carrier when appropriate.

We ship within Canada, excluding Quebec. We may exclude additional destinations when a legal, logistical, carrier or service restriction prevents delivery.

You are responsible for providing a complete and accurate recipient name, shipping address, postal code, telephone number and other requested delivery information.

Tides Peps is not responsible for loss, delay, failed delivery or additional costs resulting from inaccurate or incomplete information supplied by the customer.

Shipping and delivery dates are estimates and are not guaranteed. Delays may occur because of weather, carrier disruptions, remote destinations, high shipping volume, labour disruptions, security reviews or circumstances outside our reasonable control.

To the fullest extent permitted by law, ownership and risk of loss pass to the customer when the order is transferred to the carrier. Tides Peps is not responsible for packages that are:

  • Lost or damaged while under the carrier’s control
  • Delayed in transit
  • Stolen after delivery
  • Marked delivered by the carrier but cannot be located
  • Returned because of an incorrect or incomplete address
  • Unclaimed or refused by the recipient
  • Affected by weather, temperature or delivery conditions outside our control

Nothing in this section excludes responsibility that applicable law does not permit Tides Peps to exclude.

Customers should promptly report shipping concerns and cooperate with any carrier investigation. Tides Peps may choose to assist with a carrier claim but does not guarantee that the carrier will approve it.

11. Final Sales, Corrections and Cancellations

All sales are final, subject to applicable law and the separate Tides Peps Return and Refund Policy.

Tides Peps will take reasonable steps to correct mistakes made by Tides Peps, including situations where:

  • The wrong product was sent.
  • An item was omitted from the shipment.
  • The quantity sent does not match the accepted order.
  • Another fulfilment error was made by Tides Peps.

The available correction may include replacement, completion of the order, store credit or refund, depending on the circumstances and applicable law.

A customer may request cancellation before an order ships, but cancellation is not guaranteed and may be approved or refused at the sole discretion of Tides Peps. Once an order has entered processing or been transferred to the carrier, it cannot normally be cancelled.

The detailed requirements, reporting periods and available remedies will be set out in the Return and Refund Policy. If that policy conflicts with these Terms on a return or refund matter, the more specific Return and Refund Policy will apply, subject to applicable law.

12. Subscribe and Save

A Tides Peps account is required to create and manage a subscription.

When you start a subscription, you authorize the applicable payment provider to charge the subscription amount automatically at the selected renewal interval.

Renewals are processed on the same calendar date as the original order, or as close to that date as reasonably possible when the date is unavailable or processing circumstances require an adjustment.

The renewal schedule and applicable discount will be shown when the subscription is created.

The price assigned to an active subscription will not be increased by Tides Peps. Taxes, shipping charges or government-imposed charges may change where required.

A subscription continues until cancelled, unless it is ended by Tides Peps or cannot be renewed.

You may cancel a subscription at any time before the next renewal is processed. Cancellation stops future renewals but does not automatically cancel or refund an order that has already renewed.

If a subscribed product becomes unavailable, Tides Peps may delay or skip a renewal, contact the customer, or cancel the subscription. Tides Peps will not substitute a materially different product without customer authorization.

Tides Peps may cancel or suspend a subscription when:

  • The product is no longer available.
  • Payment repeatedly fails.
  • The subscription was created using incorrect information.
  • Fraud, misuse or a violation of these Terms is suspected.
  • Continuing the subscription is not commercially or legally practical.

13. Customer Accounts

You are responsible for:

  • Providing accurate account information
  • Maintaining the confidentiality of your password
  • Using a strong and unique password
  • Restricting access to your device and account
  • Promptly updating changed information
  • Notifying Tides Peps if unauthorized access is suspected

You are responsible for activity conducted through your account to the extent permitted by law.

Tides Peps may suspend, restrict or delete an account at its discretion when reasonably necessary to protect the website, enforce these Terms, prevent fraud or comply with the law.

Deleting an account does not automatically cancel a subscription or eliminate transaction records that Tides Peps must retain for legal, accounting, tax, payment, fraud-prevention or dispute purposes.

14. Reviews and Customer Content

Customers may be permitted to submit ratings, reviews, comments, photographs or other content.

You must only submit content that:

  • Reflects your honest experience.
  • Is accurate to the best of your knowledge.
  • Does not contain unlawful, abusive, threatening or discriminatory material.
  • Does not contain private information about another person.
  • Does not include unsupported medical, purity, safety or performance claims.
  • Does not infringe copyright, trademark or other rights.
  • Does not misrepresent an incentive, affiliation or material connection.

You retain ownership of your submitted content. By submitting it, you give Tides Peps a non-exclusive, worldwide, royalty-free licence to host, reproduce, edit for length or formatting, publish, display and use the content in connection with the website and Tides Peps marketing.

Before using a review in marketing, Tides Peps will remove identifying information such as the customer’s full name, email address, order information and account details. We may use an anonymous label or non-identifying attribution.

Tides Peps will not materially change the meaning of a review or falsely represent what a customer said. Reviews may be moderated, declined or removed when they violate these Terms, contain sensitive information or create legal or regulatory concerns.

15. Affiliate Program

Participation in the Tides Peps affiliate program is governed by separate Affiliate Terms.

These Terms do not create a right to participate in the affiliate program or receive commissions. Tides Peps may withhold or reverse referral credit arising from fraud, deceptive promotion, self-referral where prohibited, returned orders, cancelled orders or violations of the Affiliate Terms.

16. Intellectual Property

The Tides Peps website and its content, including text, product descriptions, photographs, graphics, logos, layouts, code and branding, are owned by or licensed to Tides Peps and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial purchasing and informational purposes.

You must not copy, reproduce, modify, distribute, sell, license, scrape, publish or commercially exploit website content without prior written permission, except where applicable law expressly permits the activity.

17. Website Availability and Third-Party Services

We do not guarantee that the website will always be available, uninterrupted, secure or error-free.

Tides Peps may modify, restrict, suspend or discontinue any website feature without notice.

The website may rely on third-party services for hosting, payments, shipping, analytics, email, subscriptions and other functions. Tides Peps is not responsible for the independent availability, security, content or conduct of those providers, except to the extent required by law.

Links to third-party websites are provided for convenience and do not necessarily represent endorsement.

18. Disclaimers

To the fullest extent permitted by law, the website, its content and products are provided on an “as available” basis without representations, warranties or conditions not expressly stated in these Terms.

Tides Peps does not guarantee:

  • A particular research result
  • Product suitability for a particular experiment or purpose
  • Continuous website availability
  • Error-free product descriptions or images
  • Availability of any product
  • Delivery by a specific date
  • Compatibility with third-party equipment, procedures or materials

Nothing in these Terms excludes an express or implied warranty, condition, remedy or consumer right that applicable law does not permit the parties to exclude.

19. Limitation of Liability

To the fullest extent permitted by law, Tides Peps and its owners, employees, representatives and service providers will not be liable for indirect, incidental, consequential, exemplary, punitive or special damages, including loss of profits, data, opportunity or anticipated research results.

To the fullest extent permitted by law, the total liability of Tides Peps arising from a product, order, subscription or these Terms will not exceed the amount paid to Tides Peps for the specific order giving rise to the claim.

These limitations do not apply to liability, remedies or statutory rights that cannot legally be excluded or limited.

20. Indemnity

To the extent permitted by law, you agree to indemnify and hold Tides Peps and its owners, employees and representatives harmless from third-party claims, losses and reasonable costs arising from:

  • Your unlawful use of a product
  • Human or veterinary use of a product
  • Your resale or redistribution of a product
  • Your violation of these Terms
  • False information supplied by you
  • Content submitted by you
  • Your infringement of another person’s rights

This section does not require you to indemnify Tides Peps for conduct for which Tides Peps is legally responsible.

21. Dispute Resolution

Before commencing a formal claim, you agree to contact Tides Peps through the website contact form and provide reasonable details of the dispute. The parties will attempt in good faith to resolve the matter informally.

Where permitted by applicable law, a dispute that cannot be resolved informally may be submitted to binding arbitration by written agreement of the parties or under an enforceable arbitration provision.

Any arbitration will:

  • Take place in British Columbia unless the parties agree otherwise.
  • Be conducted in English.
  • Be heard by one arbitrator.
  • Follow procedures selected by the arbitrator or agreed upon by the parties.
  • Permit the arbitrator to grant any remedy available under applicable law.

No arbitration requirement applies where it is prohibited, void or unenforceable under applicable consumer-protection legislation. Nothing in these Terms prevents a customer from exercising a right to bring a court action, regulatory complaint or other proceeding that applicable law does not allow the customer to waive.

If arbitration does not apply, the dispute will be determined by a court or tribunal with jurisdiction under the laws of British Columbia and Canada.

22. Governing Law

These Terms and any dispute relating to the website, an order or a subscription are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Mandatory consumer protections in another Canadian province or territory remain applicable where the law requires.

23. Changes to These Terms

Tides Peps may update these Terms when its products, services, website features, policies or legal obligations change.

Updated Terms will be posted on the website with a revised effective date.

Changes will not retroactively increase the price of an existing subscription. Any material change affecting an active transaction will apply only to the extent permitted by law.

Continued use of the website after updated Terms take effect constitutes acceptance of the updated Terms, subject to any additional consent required by law.

24. General Provisions

If any provision of these Terms is found invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

A failure by Tides Peps to enforce a provision is not a waiver of that provision.

Tides Peps may assign these Terms as part of a business sale, restructuring or transfer. Customers may not transfer their rights or obligations under these Terms without written permission.

These Terms, the Privacy Policy, the Return and Refund Policy, and any additional terms presented during checkout form the agreement between the customer and Tides Peps concerning use of the website and purchases.
